Traffic & Municipal Court

Municipal Court is an area in which many people give up their significant rights just because they think they are guilty due to driving while suspended, intoxicated, or without insurance. Even though you may appear guilty and indeed on the surface, may have violated the offense, it does not mean that you will be found guilty in a Municipal Court. This is important to note because the penalties are severe. In addition to financial penalties of $500 to $1000 there are terms of suspension of your license that ranging from six months to ten years. Furthermore, many of the more serious motor vehicle violations carry surcharges of up to $1000 per year. If you fail to pay your surcharge you could be left in a cycle of suspensions lasting an indeterminate term and costing you tons of money. Debts that are not necessarily dischargeable in bankruptcy.

An attorney in Municipal Court can help save you by having you plead to a reduced charge, by informing you of your defenses, and convincing the Prosecutor or Judge that you are not guilty of the offense you have been charged with. Oftentimes, people plead guilty in Municipal Court when they do have defenses costing themselves several times more money than an attorney would have cost them. The adage, penny wise pound foolish applies to Municipal Court. You can save a little money by not hiring an attorney, but you pay for the consequences for years to come.
